CO–Couple arrested Tuesday for felony child abuse

CENTER — A common-law husband and wife were arrested here Tuesday and charged with one count of felony child abuse each following an investigation begun March 16, by Saguache County Social Services and Saguache County Sheriff’s Office.

Timothy Andy Garcia, 43, and Cheryl Candace Pacheco, 26, were arrested yesterday by Saguache County Undersheriff Dan Warwick and Investigator Mark Werts. Pacheco was arrested at Blue Horizons thrift store in Saguache without incident. Garcia was arrested at the family home, 576 Wills St., Center. According to Werts Garcia attempted to prevent being taken into custody but was arrested after a short struggle. No injuries to the suspect or officers was reported.

Both Garcia and Pacheco were booked into the Saguache County Jail and bail had been set at $20,000 each on the single class four felony they are each charged with.

The victim in the case is the couple’s five-month old son, who, along with four siblings has been removed from the couple’s custody.

On March 9 the child was brought to the Rio Grande County Hospital by his mother who told emergency room staff the child had possibly jammed his finger and had been experiencing a fever for two days. When checked by the ER staff, the child was found to have a temperature of 102.4 degrees, a low oxygen level and a breathing rate of 40. Staff reported the infant was lethargic and did not cry when blood was drawn. The child was admitted to the hospital but began having increased medical problems and was transferred via air ambulance to Children’s Hospital in Aurora, Colo.
