PA–Berks man charged in child rape is on probation

NORRISTOWN — A Douglassville man arraigned on charges this week that he sexually assaulted two children between 2001 and 2003 in Berks County previously admitted to having inappropriate sexual contact with a 15-year-old Pottstown girl, according to court records.

Phillip Andrew Bazzley, 21, of West Welsh Drive, was sentenced in Montgomery County Court in January to three years’ probation after he pleaded guilty to a misdemeanor charge of corruption of a minor in connection with incidents that occurred with the 15-year-old girl in 2009.

Judge Steven T. O’Neill, who accepted a plea agreement in the case, ordered Bazzley to attend a sex offender counseling program and to abide by any treatment recommendations made by probation officials.

By pleading guilty to the charge, Bazzley admitted that on various dates in the early part of 2009 he had sexual contact with the teenage girl.

Bazzley, under questioning by his lawyer Eric E. Winter, told the judge that at the time of the incidents he was 20, that the teenager was his girlfriend and that the contact was consensual, according to a transcript of the court hearing.

Under state law, a person under age 16 is considered incapable of consenting to sex.

As part of the plea agreement, Bazzley admitted that inappropriate text messages of a sexual nature were sent to the 15-year-old girl via his cell phone, according to court papers.
